Mpumalanga Heritage — Terms and Conditions

Welcome to Mpumalanga Heritage. These terms and conditions ("Terms") govern the use of our website, membership of our organisation, and participation in our events and outings. By accessing this website, registering as a member, or taking part in any of our activities, you agree to these Terms.
1. About the organisation
Mpumalanga Heritage ("MH", "we", "our", "us") is a voluntary, non-profit heritage organisation (NPO 126-240) based in Mpumalanga, South Africa, and affiliated with the Heritage Association of South Africa (HASA). We are dedicated to the protection, research, conservation and promotion of cultural, historical and natural heritage within Mpumalanga, and are supported by volunteers, members and contributors.
2. Changes to these Terms
We may update, modify or replace these Terms at any time. The current version will always be available on our website. Your continued use of the website, membership, or participation in our activities after any change means you accept the updated Terms.
PART A — WEBSITE
3. Website use
The website is provided for informational and educational purposes only. You agree to use it lawfully, and not to: infringe the rights of others; damage, disable or impair the website; or misrepresent the organisation or its work.
4. Our content and intellectual property
Unless stated otherwise, all content on this website — including text, images, logos and design elements — is the property of Mpumalanga Heritage or is used with permission. Some images and materials are used under licence and remain the property of their owners, who are credited where required. You may view and share our content for personal, non-commercial purposes, but may not copy, reproduce, distribute or reuse it for other purposes without our permission or that of the relevant owner.
5. Contributed material
By submitting photographs, research, documents or other material to Mpumalanga Heritage, you confirm that: you own the material or have permission to share it; and it does not infringe the rights of any third party. Unless otherwise agreed, contributed material may be used by the organisation for educational, research or promotional purposes, with appropriate credit given where possible.
6. Links to other websites
Our website may link to other websites for your convenience. We are not responsible for the content, accuracy or practices of those websites, and a link does not imply our endorsement.
7. Accuracy and availability
We take care to keep the information on our website accurate and current, but cannot guarantee that it is always complete or error-free, and it should not be relied on as professional advice. We aim to keep the website available but cannot guarantee uninterrupted access.
PART B — MEMBERSHIP
8. Becoming a member
Membership is open to individuals who support the aims and objectives of Mpumalanga Heritage. To join, complete a membership application form and pay the applicable fee. Membership takes effect once your application has been received and your fee has been paid.
9. Membership fees
The membership fee is R250 per family per year (or as advised from time to time). Fees may be paid by EFT or in person at KLCBT, Nelspruit Crossing. Membership fees are non-refundable unless otherwise stated.
10. Renewals
Membership runs for the period stated at the time of joining and must be renewed to continue. If a membership is not renewed, it will lapse and access to member benefits will end.
11. Member benefits
Membership benefits may include invitations to heritage outings and events; access to talks, presentations and newsletters; and participation in heritage-related initiatives. These benefits are offered in good faith and may change over time; we do not guarantee any specific number of events or activities in a given period.
12. Member conduct
We ask all members to behave respectfully towards others, our heritage sites, and the communities we work with, and to follow the reasonable instructions of organisers at our activities. We reserve the right to suspend or terminate the membership of anyone who acts in a manner that is unlawful, unsafe, or harmful to heritage sites, other members, or the reputation of the organisation.
13. Ending membership
You may end your membership at any time by contacting us. We may end a membership in line with clause 12, or if a fee remains unpaid. Fees already paid are not refunded when a membership ends, except at our discretion.
PART C — EVENTS, OUTINGS AND ACTIVITIES
14. Booking and payment
Some events and outings require booking in advance and, where applicable, payment of a fee. Your place is confirmed once we have received your booking and any required payment.
15. Cancellations and refunds
If you need to cancel a booking, please tell us as soon as possible. Refunds of any event fees are at our discretion and may depend on costs already committed on your behalf. We may cancel, postpone or change an event — for example due to weather, safety, low numbers or circumstances beyond our control — and will let you know and, where reasonable, offer a refund or alternative.
16. Participation and personal responsibility
Participation in outings, site visits, talks and events is voluntary and undertaken at your own risk. You acknowledge that heritage sites may be remote, uneven or environmentally sensitive; that weather and terrain conditions may vary; and that some sites may have limited access or facilities. You are responsible for assessing whether an activity is suitable for you, for your own health, fitness and safety, and for bringing appropriate clothing, footwear and any personal medication. You agree to follow the instructions given by organisers and guides at all times.
17. Indemnity and liability
To the fullest extent permitted by law, you take part in our events and outings at your own risk. Mpumalanga Heritage, its committee members, organisers, volunteers and affiliates will not be held liable for any injury, loss, damage, inconvenience or death suffered by you or your dependants arising from your participation, except where such liability cannot lawfully be excluded or is caused by our gross negligence. Nothing in these Terms excludes or limits any liability that may not lawfully be excluded under South African law. For certain outings, we may ask you to sign a separate indemnity form before taking part.
18. Heritage protection and ethical conduct
All members and participants are required to: respect and protect heritage sites and artefacts; refrain from removing, damaging or disturbing heritage material; and comply with all safety and conservation guidelines and ethical heritage practices. Any behaviour that threatens heritage resources may result in removal from an activity or termination of membership.
19. Children at events
Children are welcome at many of our activities but remain the responsibility of their parent or guardian, who must accompany and supervise them at all times.
20. Third parties
Some events use third-party venues, transport or service providers. We are not responsible for the acts, omissions or services of those third parties, whose own terms may apply.
21. Photography at events
Photographs and recordings are sometimes taken at our events and may be used in our newsletters, website and social media to promote our work. If you (or a child in your care) would prefer not to be photographed, please tell the organiser and we will do our best to respect that. Our use of personal information is governed by our Privacy Policy.
PART D — GENERAL
22. Privacy
We handle personal information in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA). Please read our Privacy Policy together with these Terms.
23. Consumer rights
Nothing in these Terms is intended to limit any rights you may have under the Consumer Protection Act or other South African law that cannot lawfully be excluded.
24. Governing law
These Terms are governed by the laws of the Republic of South Africa.
